1. Purchase Procedures

By connecting to the site, you can directly purchase our products, browsing their descriptions and specifications. You can add in your shopping cart the products you like the most and if you wish to purchase them, all you have to do is just click on the "Order" button, a transaction that does not commit you to purchase them. Subsequently, an order form will appear where you will be asked to enter your personal data, choose the payment method and shipping address. By pressing enter you can confirm the purchase order. Once the order specifications and the correctness of the data entered are confirmed, the order form will be sent to Alpe del Garda. The company reserves the right not to deliver the products if, as a result of verifications carried out, the data entered are incorrect or incomplete.

2. Transparency of product prices

The prices indicated for all products shown in the online store include VAT . Shipping costs are shown in the calculation showing the total price of the order and vary depending on the location of the product destination.

3. Product delivery

Our products are shipped via "express carrier", which ensures in Italy and abroad delivery at home within 24 to 72 hours from the shipping date. For logistical reasons, orders are handed out to the carrier every Tuesday and Friday. All our products travel inside thermal containers in polystyrene foam to prevent temperature fluctuations thanks to thermo-regulation obtained with dry ice, which ensures the right temperature and humidity for the products.

At the time of the order, it is necessary to list an address where a person is available to receive the order during the entire day. If this is not the case and the carrier cannot deliver the order, the responsibility rests solely on the client, and he/she will have to personally call the pertaining carrier office in order to agree on the time for any subsequent delivery, or he /she will have to go to the carrier office to pick-up the goods.

4. Warranty

Alpe del Garda ensures that its products comply with the specifications that you have indicated on the order form.

5. Payment

Payment of the amount corresponding to the order sent to Alpe del Garda may take place as follows:

  • by credit card directly from your home. You will receive payment confirmation from the Bank.
  • by bank transfer on the current account of Alpe del Garda at Banca Intesa SanPaolo IBAN: IT 86 V 030 6955 1800 0000 3940 183 ; BIC : BCITITMM080.

6. Withdrawal right

As established by Legislative Decree No. 185 dated May 22, 1999 related to consumer protection on remote contracts, if you are a consumer who acted for purposes other than those of your professional activity, you may withdraw from the purchase agreement, returning the purchased goods to ALPE DEL GARDA and obtaining a refund of the price paid, without any additional charges or penalties borne by you.

You may withdraw from the purchase within 10 business days from the receipt of the product(s) you purchased following the Withdrawal procedure explained below. However, this right cannot be exercised in the following cases:

  • Perishable foodstuffs, according to paragraph 1 of article 3 of Legislative Decree No. 50/92 and according to paragraph 3 of article 5 of Legislative Decree No. 185/99;
  • Custom prepared goods or clearly customized goods or goods that, due to their nature, cannot be returned or are at risk of rapid deterioration or alteration;
  • Packaged and sealed products opened by the customer.


WITHDRAWAL PROCEDURE

If you wish to exercise the right of withdrawal, you will have to return the goods received, at your own expenses, intact and not used, to Alpe del Garda within 10 business days from the date of receipt of the goods, attaching a copy of the invoice or transport document. The return will have to take place by free port insured parcel. No cash on delivery or carriage forward parcels will be accepted. Alpe del Garda will issue the refund by bank wire transfer, after receipt of the notification in which the consumer expressed the will to exercise the withdrawal right. Shipping and delivery costs will be borne by the consumer. In order to exercise the right of withdrawal, the product and its packaging shall be undamaged.

7. Privacy

PRIVACY POLICY PURSUANT TO ARTICLE 24, LAW 196/03
Dear Valued Customer, pursuant to Article 13 of the law in question, Cooperativa Alpe del Garda is obligated to inform you about how it will be processing your personal data that you or others will provide to us or of which it will become aware during our business relationships, concerning:

a) purpose of the data processing
The data collected are processed for the following purposes:
1) fulfilment of tax, accounting and civil obligations;
2) management of the contractual relationship between the parties.

b) processing methods
Data processing takes place both in manual and automated form. In particular, the automated form allows the organization of data for multiple search criteria; however, no data extraction or aggregation for purposes other than those stated in the previous paragraph is made, and no assessments solely based on the automated data processed are made;

c) nature of the data supply and consequence of a possible refusal
The provision of personal data collected for the purposes referred to in points a.1 and a.2 is mandatory under penalty of not being able to implement a contractual relationship.

d) communication areas
Beyond the persons in charge who work under the direct control of the Cooperative (administrative personnel, operational personnel), for the purposes referred to in point (a) the data may be communicated to public bodies or public administration agencies who may request them to carry out institutional functions, within the limits established by the laws and regulations.
The data are communicated to shipping companies used for the deliveries.
Data concerning the economic relationship between the parties and your bank details may be communicated to credit institutions if a payment by bank wire transfer is agreed. If data processing not aimed at fulfilling contractual obligations or not referred to the implementation of economic activities were put in place, we will ask you for specific authorisation.

e) rights
In the role of concerned parties, you are entitled to exercise the rights referred to in Article 7 of this Law (access, update, deletion) by writing to the Data Supervisor as described in the next point.

f) Data Controller and Data Supervisor
The Data Controller is the Cooperative Alpe del Garda.
The Data Supervisor is the Pro Tempore Chairman of the Cooperative domiciled for the task at the office of the Cooperative.

8. Applicable Law and Court of Jurisdiction

The contracts governed by these General Terms and Conditions are governed by Italian law. For any disputes arising from the performance of the agreements covered by these General Terms and Conditions, the place of jurisdiction will be the Court of residence or domicile of the Customer. Pursuant to and by effect of articles 1341 and 1342 of the Civil Code, I state that I have read and understood these Terms and Conditions of Sales and expressly accept the following clauses: 1,2,3,4,5,6,7,8.

Online Consumer Dispute Resolution
Consumers residing in Europe should be aware of the fact that the European Commission has set up an online platform that provides an alternative dispute resolution tool. This tool can be used by European consumers to resolve any dispute relating to, and/or arising from, goods and services purchased online without going to court.
